These Terms of Service ("Terms") govern your access to and use of mielaharvest.com (the "Site"), including any purchases made through the Site.

The Site is operated by MIELA LLC, a California limited liability company ("MIELA," "we," "us," or "our"). By accessing the Site, placing an order, or otherwise using our services, you agree to these Terms and to any additional policies referenced in them, including our Privacy Policy and Refund Policy.

Please read these Terms carefully. If you do not agree with them, you should not use the Site.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer our products.

1. Eligibility and Online Store Terms

You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, to make a purchase through the Site.

You may not use the Site or our products for any unlawful or unauthorized purpose, violate any applicable law in connection with your use of the Site, interfere with the security or operation of the Site, or transmit malicious code.

We reserve the right to refuse service, restrict access, cancel orders, or terminate use of the Site where reasonably necessary to protect MIELA, our customers, our systems, or third parties, or where we reasonably believe these Terms or applicable law have been violated.

2. Our Products

MIELA offers extra virgin olive oil and may offer other food, culinary, lifestyle, or related products from time to time.

Our olive oil is an agricultural food product. Natural characteristics including flavor, aroma, color, bitterness, pungency, sediment, appearance, and chemical composition may vary between harvests, batches, storage conditions, and over time.

Such natural variation does not necessarily indicate that a product is defective.

We make reasonable efforts to accurately describe and photograph our products. However, packaging, labeling, colors, appearance, specifications, harvest information, and other product details may occasionally differ from photographs or descriptions displayed on the Site.

Product availability is not guaranteed. Certain products may be produced in limited quantities or from a particular harvest and may sell out without notice.

We reserve the right to limit quantities, discontinue products, restrict sales by geographic area, or refuse orders where reasonably necessary.

3. Harvest and Laboratory Information

Certain MIELA products may display information regarding laboratory testing, polyphenol content, acidity, peroxide values, phenolic compounds, harvest characteristics, origin, or other measurements.

Unless expressly stated otherwise, laboratory results displayed for a particular harvest or batch refer to the sample, harvest, or batch identified in the applicable report. Agricultural products naturally change over time, and measurements may vary between harvests, lots, laboratories, testing methods, and dates of analysis.

A laboratory result associated with one harvest should not be interpreted as a guarantee that every future harvest or bottle will produce an identical result.

Where we provide access to a certificate of analysis or laboratory report, the report itself should be consulted for the specific testing methodology, sample information, testing date, results, and limitations applicable to that analysis.

4. Food, Wellness and Health Information

MIELA products are foods, not drugs or dietary supplements.

Information appearing on the Site, our social media channels, emails, advertisements, packaging, educational materials, recipes, journals, or other communications may discuss olive oil, polyphenols, oleocanthal, oleacein, antioxidants, nutrition, scientific research, wellness, or related subjects.

This information is provided for general educational and informational purposes. It is not medical advice and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

References to scientific studies or research do not mean that consuming a MIELA product will produce the same outcome observed in a particular study. Research findings may depend on study design, population, dosage, duration, dietary patterns, and numerous other factors.

Individual responses to foods vary. If you have a medical condition, food allergy, dietary restriction, are pregnant or nursing, take medication, or have questions about whether a product is appropriate for you, consult a qualified healthcare professional.

Never disregard professional medical advice or delay seeking it because of information you have read on our Site or other MIELA materials.

5. Q900

MIELA may use names or expressions such as "Q900" or "Q900 Shot" in connection with certain products, rituals, serving suggestions, collections, or marketing materials.

Unless expressly stated otherwise, these terms are MIELA branding and should not be interpreted as a medical classification, pharmaceutical dosage, standardized medical protocol, or guarantee of a particular health outcome.

Any serving suggestions are culinary or general-use suggestions unless expressly stated otherwise.

6. Orders and Acceptance

Submitting an order does not guarantee acceptance of that order.

After you place an order, you may receive an electronic confirmation acknowledging that we received it. We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including suspected fraud, payment issues, inventory errors, pricing errors, unauthorized resale, shipping restrictions, or product unavailability.

If we cancel an order after payment has been successfully collected, we will refund the applicable canceled amount to the original payment method.

You are responsible for providing complete and accurate billing, shipping, contact, and payment information.

Please review your information carefully before submitting your order. MIELA is not responsible for delivery problems resulting from inaccurate or incomplete information supplied by the customer, except as otherwise required by law.

7. Pricing and Payment

All prices displayed on the Site are stated in U.S. dollars unless otherwise indicated.

Prices, promotions, products, and availability may change without notice. Changes will not affect an order already accepted by us except where correction is permitted by applicable law.

Applicable taxes, shipping charges, discounts, and other charges will be shown at checkout when applicable.

We reserve the right to correct typographical, pricing, promotional, or other errors. If an error affects an order you have already placed, we may contact you to provide the opportunity to proceed at the corrected price or cancel the affected order and receive a refund.

Payment processing may be provided by Shopify or other third-party payment providers. Your use of those services may also be subject to the applicable provider's terms and privacy practices.

8. Shipping

MIELA currently ships only within the contiguous United States. We do not currently ship to Alaska, Hawaii, U.S. territories, or international destinations.

Please allow approximately 3–5 business days for your order to be shipped. Business days exclude weekends and U.S. holidays.

Processing and delivery estimates are estimates rather than guarantees. Carrier delays, severe weather, natural disasters, high-volume periods, incorrect addresses, transportation disruptions, or other circumstances outside our reasonable control may affect delivery.

Orders qualifying for MIELA's current free-shipping promotion receive free standard shipping on orders over $100, subject to any conditions displayed at checkout. We may modify or discontinue shipping promotions for future orders.

Once an order has shipped, tracking information may be provided when available.

If tracking indicates a delivery issue or your package appears to be lost, please contact hello@mielaharvest.com so we can investigate and, where appropriate, assist with the carrier.

9. Final Sale, Damages and Order Issues

Because MIELA sells food and consumable products, all sales are final. We do not accept returns or exchanges because of preference, change of mind, taste preference, or other non-defect reasons, whether a product has been opened or remains unopened, except where required by applicable law.

This policy does not affect any rights or remedies that cannot legally be excluded.

If your order arrives damaged or defective, contains an incorrect product, or an item is missing, contact us at hello@mielaharvest.com within 7 days of delivery.

Please include:

your order number;
a description of the problem;
clear photographs of the product or bottle;
photographs of the packaging; and
a photograph of the shipping label.

We may request additional information reasonably necessary to investigate the issue.

After reviewing an eligible claim, MIELA may provide a replacement or refund, as appropriate under the circumstances and applicable law. If a replacement is unavailable, we may issue a refund for the affected product.

Any approved refund will ordinarily be returned to the original payment method. Financial institutions may require additional time to process and post a refund.

10. Order Changes and Cancellations

If you need to request a change or cancellation, contact hello@mielaharvest.com as soon as possible.

We cannot guarantee that an order can be changed or canceled after it has been submitted. Once an order has entered fulfillment or has shipped, it generally cannot be canceled.

Nothing in this section limits rights available to you under applicable law.

11. Subscriptions and Automatic Renewal

MIELA may offer subscription, Subscribe & Save, recurring-delivery, or other automatically renewing purchase options.

If you choose a subscription, the specific price, delivery frequency, billing frequency, discount, renewal terms, and other material subscription terms will be presented to you before you complete your purchase.

By affirmatively enrolling in a subscription, you authorize MIELA and its payment providers to charge the payment method associated with your subscription at the disclosed recurring interval until you cancel, subject to applicable law.

Subscription prices, discounts, shipping charges, or other terms may change in the future. Where required by law, we will provide advance notice and obtain any consent required before a change takes effect.

You may cancel a subscription in accordance with the cancellation method provided when you enroll and in your subscription account or management interface. Customers who enroll online will be provided an online method to cancel their subscription, as required by applicable law.

Cancellation must occur before the applicable renewal or processing deadline displayed for your subscription to prevent the next order from being processed. Once a recurring order has already entered fulfillment, it may be treated as a completed food order and subject to our Refund Policy, except where otherwise required by law.

We will provide subscription confirmations, renewal reminders, price-change notices, cancellation methods, and other notices as required by applicable law.

Subscription enrollment is optional and is not required to purchase products from MIELA on a one-time basis where one-time purchase is offered.

12. Limited Harvests and Purchase Limits

Some MIELA products may be made from limited harvests or available in limited quantities.

We may establish reasonable purchase limits per person, household, payment method, shipping address, customer account, or order in order to preserve product availability, prevent fraud, or prevent unauthorized resale.

Availability displayed on the Site may change before an order is accepted.

13. Personal Use and Unauthorized Resale

Products purchased directly from MIELA through the Site are intended for personal use unless MIELA has expressly authorized otherwise in writing.

You may not purchase products from the Site for commercial resale, redistribution, marketplace resale, export for resale, or other commercial purposes without our prior written authorization.

We reserve the right to refuse, limit, or cancel orders that we reasonably believe are intended for unauthorized resale or distribution.

14. Accounts and Customer Information

If the Site permits you to create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account to the extent permitted by law.

You agree to provide accurate and current information and to promptly update information when necessary.

Please notify us promptly if you believe your account has been accessed or used without authorization.

15. Intellectual Property

The Site and its contents, including MIELA's name, logos, trademarks, trade dress, product names, Q900 branding, photographs, videos, graphics, illustrations, artwork, designs, packaging, text, recipes, editorial content, website design, and other original materials, are owned by or licensed to MIELA and are protected by applicable intellectual-property laws.

Except as expressly permitted by us in writing or allowed by applicable law, you may not reproduce, copy, republish, distribute, modify, sell, exploit, scrape, create derivative works from, or commercially use MIELA content.

You may use the Site for your personal, noncommercial use in accordance with these Terms.

No license or ownership interest in MIELA's intellectual property is transferred to you through your use of the Site or purchase of our products.

16. User Content, Reviews and Feedback

If you voluntarily submit a product review, photograph, comment, feedback, suggestion, or other content to MIELA or through functionality specifically intended for public or promotional submissions, you represent that you have the right to submit that material and that it does not violate the rights of another person.

You grant MIELA a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute such submitted content in connection with operating, improving, and promoting MIELA, subject to applicable law and our Privacy Policy.

We may remove or decline to publish content that we reasonably believe is unlawful, fraudulent, abusive, misleading, infringing, or otherwise inappropriate.

You remain responsible for content you submit.

17. Email and SMS Marketing

If you separately opt in to receive marketing communications from MIELA, we may send you promotional emails or text messages in accordance with your consent and applicable law.

Marketing consent is not a condition of purchase.

Email marketing may be delivered through MIELA, Shopify, Klaviyo, or other service providers acting on our behalf. You may unsubscribe from promotional emails by using the unsubscribe link included in those communications.

If you opt in to SMS marketing, you may receive recurring promotional and marketing text messages, including product announcements, offers, launch information, or cart-related messages. Message frequency may vary. Message and data rates may apply depending on your mobile carrier and plan.

You may opt out of promotional SMS messages at any time by replying STOP to a MIELA marketing message. Where available, reply HELP for assistance or contact hello@mielaharvest.com.

Carriers are not responsible for delayed or undelivered messages.

Transactional communications relating to an order, account, customer-service request, or other transaction may be treated separately from marketing communications where permitted by law.

Our collection and use of personal information is described in our Privacy Policy.

18. Privacy

Your use of the Site and submission of personal information are subject to our Privacy Policy, which is incorporated into these Terms by reference.

Our Site and services may use third-party providers, including Shopify and Klaviyo, to provide e-commerce, communications, analytics, payment, marketing, and other functionality.

Those providers may process information in accordance with their own applicable terms and privacy practices.

19. Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, payment services, social networks, applications, tools, or services.

We do not control third-party websites or services and are not responsible for their content, availability, security, privacy practices, products, or conduct.

Your interactions with third parties may be governed by separate terms and policies. You should review those terms before using a third-party service.

20. Accuracy of Site Information

We work to keep information on the Site accurate and current, but errors, omissions, outdated information, or technical inaccuracies may occasionally occur.

These may involve product descriptions, laboratory information, photographs, pricing, promotions, availability, inventory, shipping charges, delivery estimates, or other information.

We reserve the right to correct errors, update information, or cancel an affected order where appropriate, subject to applicable law.

Historical information may be provided for reference and should not necessarily be understood as describing the current harvest, inventory, product, scientific consensus, or other current circumstances.

21. Prohibited Uses

You may not use the Site:

(a) for an unlawful or fraudulent purpose;

(b) to violate applicable local, state, federal, or international law;

(d) to transmit malicious code, viruses, malware, or other harmful material;

(e) to interfere with or attempt to circumvent the security or functionality of the Site;

(f) to collect personal information about other users without authorization;

(g) to spam, phish, scrape, crawl, harvest, or access the Site through unauthorized automated means;

(h) to impersonate another person or provide intentionally false or misleading information;

(i) to conduct unauthorized resale or other commercial exploitation of MIELA products or Site content; or

(j) to engage in conduct that could damage, disable, overburden, or impair the Site or our services.

We may restrict or terminate access for violations of this section.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

MIELA DOES NOT GUARANTEE THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIELA DISCLAIMS WARRANTIES REGARDING THE SITE THAT ARE NOT EXPRESSLY PROVIDED IN THESE TERMS OR REQUIRED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

23. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIELA LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR SERVICES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIELA'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO A PARTICULAR PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO MIELA FOR THE PRODUCT GIVING RISE TO THE CLAIM.

THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING WHERE APPLICABLE LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY LAW.

Some jurisdictions do not allow certain warranty exclusions or limitations of liability, so some of these provisions may not apply to you.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless MIELA LLC and its members, officers, employees, affiliates, agents, contractors, service providers, and licensors from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your material breach of these Terms, your violation of applicable law, or content you submit that violates a third party's rights.

This provision does not require you to indemnify MIELA for MIELA's own unlawful conduct, negligence, or other liability to the extent such indemnification is prohibited by applicable law.

25. Service Changes and Availability

We may modify, suspend, discontinue, or change all or part of the Site, its features, or products from time to time.

We are not responsible for temporary interruptions or circumstances beyond our reasonable control, including failures or delays caused by internet or telecommunications outages, carrier disruptions, natural disasters, severe weather, labor disputes, government action, supply interruptions, cyber incidents affecting third-party infrastructure, or similar events.

Nothing in this section limits rights or remedies available to consumers under applicable law.

26. Termination

These Terms remain effective while you use the Site.

We may suspend or terminate access to the Site where we reasonably believe you have materially violated these Terms, engaged in fraud or unlawful activity, threatened the security of the Site, or misused our services.

Provisions that by their nature should survive termination, including intellectual-property provisions, disclaimers, limitations of liability, indemnification obligations, and governing-law provisions, will survive as applicable.

27. Governing Law

These Terms and your use of the Site are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent another law must apply as a matter of law.

Nothing in these Terms deprives you of consumer protections or other rights that cannot be waived under applicable law.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where necessary, severed from these Terms.

The remaining provisions will continue in full force and effect.

29. No Waiver

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

30. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and any other policies or terms expressly incorporated by reference, constitute the agreement between you and MIELA concerning your use of the Site and purchases made through it.

If product-specific or promotional terms conflict with these Terms, the more specific terms will control with respect to that product or promotion to the extent permitted by law.

31. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, business practices, or legal obligations.

When we make changes, we will post the updated Terms on this page and update the "Last updated" date above.

Where required by law, we will provide additional notice or obtain consent before material changes become effective.

Your continued use of the Site after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by applicable law.
